Terms of Service

1. Acceptance of Terms

By accessing or using Dockcert("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms. If you do not agree, do not use the Service.

2. Description of Service

Dockcert is a trade document verification platform. It ingests shipment document bundles, extracts structured data using AI, and checks documents against trade finance rules (including UCP 600 and ISBP 821) and government-published reference lists. The Service is intended to assist professionals in identifying potential discrepancies; it does not constitute legal, financial, or professional compliance advice.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at legal@dockcert.com if you suspect unauthorised access. Accounts must be registered with accurate information. We reserve the right to suspend accounts that provide false information.

4. Acceptable Use

You agree not to:

• Upload documents you do not have the right to share
• Attempt to reverse-engineer or extract the underlying AI models or rule packs
• Use the Service to facilitate fraud, money laundering, or sanctions evasion
• Circumvent usage quotas or access controls
• Introduce malware or conduct denial-of-service attacks
• Share your account credentials with unauthorised parties

5. Data and Documents

You retain ownership of all documents and data you upload. By uploading documents, you grant Dockcert a limited licence to process them solely for the purpose of providing the Service. We do not share your documents with third parties except as required to operate the Service (e.g., cloud storage providers). See our Privacy Policy for details.

6. AI and Accuracy

The Service uses AI to extract data and identify discrepancies. AI output can be incorrect. Results are provided for informational purposes only and do not constitute a guarantee that documents are free from errors or are compliant with applicable rules. You are solely responsible for verifying findings and for any decisions made based on Service output. Dockcert is not liable for losses arising from reliance on AI-generated results.

7. Reference Lookups

The Service provides reference lookups against publicly available government lists (OFAC SDN, EU FSF, UN Security Council, UK OFSI, BIS Entity List). Lookup results are informational only and do not constitute sanctions screening or compliance clearance. Dockcertmakes no warranty that the underlying lists are complete, current, or error-free. Lists may be delayed, incomplete, or outdated at any time. Compliance with applicable sanctions and trade laws remains your sole responsibility. You must independently verify all results against your organisation's designated screening provider before making any trade or business decisions.

8. Billing and Payments

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law. Plan downgrades take effect at the next billing cycle. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.

9. Intellectual Property

Dockcert retains all rights to the Service, including the software, rule packs, AI models, and user interface. These terms do not grant you any ownership rights. You may not copy, modify, or distribute any part of the Service without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Dockcert's liability for any claim arising from use of the Service is limited to the fees paid by you in the 12 months preceding the claim. Dockcert is not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss, even if advised of the possibility of such damages.

11. Termination

You may terminate your account at any time from Settings. We may suspend or terminate accounts that violate these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Document data is deleted within 30 days of account closure unless longer retention is required by law.

12. Changes to Terms

We may update these terms from time to time. Material changes will be notified by email at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
